Welcome to Trillionlytics Agency, Inc. (“Trillionlytics,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our software as a service platform, including CRM tools, automations, templates, AI features, support, training, and any additional services provided by Trillionlytics Agency (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the platform.

1. Free Trial

Trillionlytics offers a 7 day free trial to allow you to explore the platform before committing to a paid subscription.

• Full access to your selected plan is provided during the trial
• You may cancel at any time before the trial ends to avoid being charged
• If not canceled, your subscription will automatically convert to a paid plan
• Once the trial converts, all payments are final and non refundable

2. Subscription and Billing

Trillionlytics operates on a recurring monthly subscription model unless otherwise stated in writing.

• You are responsible for maintaining valid payment information
• Failed or declined payments may result in suspension or termination
• Additional services such as branding, custom builds, snapshots, or consulting may incur separate fees
• Subscription fees do not include third party costs such as phone, email, SMS, or advertising spend.

Additional Accounts During Trial Period

If you purchase a plan that includes multiple or additional accounts, only one account will be accessible during the free trial period. Additional accounts will become available after the trial period ends and the subscription converts to a paid plan.

If you need immediate access to all included accounts, you may choose to cancel the trial early, which will activate billing right away. Once billing begins, all payments are final and non refundable.

3. Data Ownership and Access

You retain ownership of all data entered into your CRM account.

If your subscription is canceled or suspended:
• Platform access will be disabled
• You may request one time temporary access within 5 days to retrieve your data
• After the grace period, data may no longer be accessible unless reactivated or transferred

You are responsible for maintaining your own backups. Trillionlytics is not liable for lost data after termination.

4. Account Transfers

If you request to transfer your account to another agency or provider:

• A one time transfer fee of $997 applies
• Payment must be received before the transfer begins
• You must complete the official Trillionlytics Account Transfer Form before any transfer is processed
• Data and user generated assets are included
• Proprietary Trillionlytics systems, templates, workflows, and automations are excluded unless approved in writing
• Transfer timelines are estimates and not guaranteed

Transfer requests will not be initiated until the required form is submitted in full and verified by our team.

5. Refund Policy

All sales are final once billing begins.

No refunds are issued for:
• Unused time or early cancellations
• Failure to use the platform
• Setup delays caused by the user
• Dissatisfaction after activation

You are encouraged to fully explore the trial before purchasing.

6. What Is Included

Active subscriptions include access to:
• White labeled CRM platform
• Automations, workflows, and pipelines
• Community access with preloaded courses
• Live weekly trainings and replays
• Ongoing platform updates

Custom development, advanced builds, or done for you services are billed separately unless stated otherwise.

7. Acceptable Use Policy

You agree to use Trillionlytics only for lawful and ethical business purposes.

Prohibited uses include:
• Spam, phishing, or deceptive marketing
• Fraudulent or illegal activity
• Misuse of AI tools to mislead consumers
• Attempts to bypass platform safeguards

Trillionlytics reserves the right to suspend or terminate accounts for violations without notice.

8. Intellectual Property

All systems, workflows, templates, automations, training materials, graphics, and documentation created by Trillionlytics are the exclusive intellectual property of Trillionlytics Agency, Inc.

You may not copy, resell, redistribute, or share proprietary materials without written permission. Unauthorized use may result in termination and legal action.

9. No Guarantees or Earnings Claims

Trillionlytics does not guarantee revenue, leads, funding, approvals, conversions, or business success.

All tools, examples, and training are provided for educational and operational support only. Results depend on your implementation, compliance, and business practices.

10. Support Scope Disclaimer

Support includes guidance and technical assistance only.

• Support does not include execution unless purchased separately
• Response times may vary during peak periods
• Trillionlytics is not responsible for outages caused by third party providers

11. AI Tools Disclaimer

AI features are provided to assist with content and automation.

• AI outputs are not guaranteed to be accurate or compliant
• You are responsible for reviewing all AI generated content
• Trillionlytics is not liable for ad rejections, messaging violations, or account bans

12. Tax, Legal, and Compliance Disclaimer

Trillionlytics does not provide tax, legal, or financial advice.

You are responsible for compliance with IRS regulations, state laws, FTC, CFPB, TCPA, A2P 10DLC, and all applicable rules. Templates and workflows do not guarantee compliance.

13. Sub Accounts and White Label Access

Each sub account or partner is responsible for its own data, marketing practices, and compliance.

Trillionlytics is not liable for actions taken by sub accounts. Violations may result in suspension.

14. Communication and A2P Compliance

You are responsible for maintaining consent and compliance for all SMS, MMS, email, and call communications.

Trillionlytics provides tools but does not assume responsibility for content approval, delivery, or compliance enforcement.

15. Integrations and Third Party Tools

Trillionlytics may integrate with third party platforms including Stripe, Twilio, Mailgun, Meta, Google, and others.

We do not control or guarantee third party services. You are responsible for maintaining your own accounts and credentials.

16. Account Sharing Restrictions

Subscriptions are for use by your business only.

Unauthorized sharing, resale, or external access may result in termination without refund.

17. Chargebacks and Disputes

Chargebacks may result in immediate suspension.

You are responsible for fees, penalties, or costs incurred due to disputes or reversals.

18. Limitation of Liability

Trillionlytics is not liable for indirect, incidental, or consequential damages.

Total liability shall not exceed the amount paid during the previous billing cycle.

19. Termination

You may cancel at any time.

Upon termination:
• Access is revoked
• Data retrieval is available for 5 days upon request

Trillionlytics may terminate accounts for non payment or violations.

20. Modifications

We may update these Terms at any time.

Continued use of the Services constitutes acceptance of revised Terms.

21. Governing Law

These Terms are governed by the laws of the State of Texas. All disputes shall be handled within Texas jurisdiction.

22. Snapshot Resale and Use Restriction

Snapshots are non refundable, non transferable, and for single account use only.

Resale, duplication, or redistribution is strictly prohibited and may result in termination and legal action.
